Definition of Murder
In the Ohio Revised Code, there are two types of crimes that involve the
killing another person: murder and manslaughter.
ORC § 2903.02 defines murder as purposefully causing the death of another, including
terminating another's pregnancy or causing someone's death during
the commission or attempted commission of a felony. This offense is punishable
under § 2929.02 by a prison sentence of 15 years to life.
An individual can also face charges of aggravated murder, which involves
the premeditated act of murder; the murder of a person under 13 years
old; or the murder of a law enforcement officer. Aggravated murder is
punishable by life in prison, or the death penalty. Those that are released
may be forced to pay restitution to family victims, and could also face
Voluntary Manslaughter is defined under
ORC § 2903.03 as knowingly causing the death of another person while in a sudden passion
and / or due to sexual motivation. Involuntary manslaughter (
ORC § 2903.04) is defined as unintentionally causing a person's death while committing
a felony. Each of these crimes is a felony in the first degree and is
punishable by a prison sentence of 3 - 11 years, the potential of being
forced to pay restitution to family members, as well as up to $25,000 in fines.
