Plea Agreement - Reduced Sentence
The client was indicted in federal court with receipt, distribution and transportation of child pornography s. If convicted, the defendant faced a possible sentence of 20 years. Even though the Government had a strong case, which included a confession by the client, Attorney Nemecek was able to negotiate a favorable plea agreement that significantly reduced the potential penalties that could be imposed. Based upon the arguments and mitigating evidence that Attorney Nemecek presented, the court granted a substantial downward variance from the recommended guideline range, resulting in a sentence that was less than half of what was recommended and/or requested by the Government.
