The offense can be filed as a misdemeanor in the first degree or as a fourth-degree felony, depending on what is alleged to have taken place.

Negligent assault (§ 2903.14) is a misdemeanor. Aggravated assault (§ 2903.12), which is committed in "sudden passion or in a sudden fit of rage," is a felony offense, as is felonious assault (§ 2903.11) involving a deadly weapon.
